WAIVER AND RELEASE FROM LIABILITY 

I hereby acknowledge and agree that both Marshall Thompson, LLC, a Colorado limited liability company, and Marshall Thompson individually (referred to collectively as “I” throughout this document) have a limited role in providing services to you. By undertaking to receive or benefit from my services, and by signing this WAIVER AND RELEASE FROM LIABILITY, you hereby agree as follows:

You acknowledge and agree that I am not a doctor, I do not prescribe, diagnose, treat or mitigate disease, nor have I represented myself as a licensed medical person. Any information provided by myself or Marshall Thompson, LLC is intended for educational purposes only and is not intended to replace the advice of a physician. I encourage you to seek the guidance of a well-informed and qualified medical professional regarding all matters of prescription, diagnosis, treatment or mitigation of disease, and that you inform them (and keep them informed) regarding any new therapies, food or dietary supplement changes you choose to make, natural or otherwise. If you are already on any prescription medications I strongly encourage you to do everything you can to become informed about any side effects or possible interactions with anything you are considering introducing into your body. I never dissuade against the continuation of any of the aforementioned pursuits. 

Because research in the health sciences is constantly changing and growing, as well as the individual human body adapting to new and unique contextual and environment demands (many of which are relatively new in human history), none of us can know everything about human health, much less everything about your individual health. This in mind, you acknowledge and understand that I am an educator who offers consulting and coaching service, and that I have in no way represented myself as knowing everything about health, neither in general nor specific to you. 

You further give me permission and agree for me to offer an assessment of your own and/or your child’s health situation and to offer suggestions, acknowledging that I share only what I would do to support optimal health and function if I were in your context with your given health projects, taking into consideration physical, mental, emotional, environmental and spiritual aspects of the individual. 

All education and services offered by Marshall Thompson and Marshall Thompson LLC originate from a knowledge base that, while inherently limited, includes formal certifications, apprenticeships, personal experiences, as well as that of those I have worked with, and a lifetime of continual study and investigation of current health knowledge, new and old. This includes, but is not limited to, published research, as well as other studies, writings, presentations, records, and experiences of healthcare practitioners of allopathic medicine, herbalist, homeopaths, naturopaths, and other health and sciences professionals and researchers.

You acknowledge that my certifications include Certified Natural Health Professional, Certified BANT (Building Antibodies and Neutralizing Toxins) practitioner, MovNat Certified Trainer Level II, Personal Trainer, and SpartanSGX Certified Coach. Moreover, I am not, nor do I seek to be at this time, under any form of health professional licensure limitations.

While the information, methods, techniques, modalities and products that I educate, consult, coach on and utilize for these purposes are generally safe and support health, everyone is unique and there may be health risks associated with some, including but not limited to: aggravation of pre‐existing health imbalances or symptoms, injury, and unforeseen or allergic reactions if you choose to implement in practice any of the education I share. Moreover, while at times I may offer non-intrusive hands-on cues or assistance as needed to support you in your pursuit of health and your body’s restoration of healthy position, any bodily contact we make is not represented as therapeutic, treatment, or mitigation of disease. Therefore, while I will assist you with learning and understanding ways that you can care for your own health, you expressly acknowledge and agree that you personally assume all risk and liability related to your use or implementation of these services and information. You expressly acknowledge and agree any reliance by you on the accuracy, completeness or usefulness of such information and service is at your own risk. You further expressly acknowledge and agree I have not made, and no statement of mine may be construed as having made, any express or implied warranty about any information, methods, techniques, modalities or products related that are sold through or linked to by any Marshall Thompson, LLC entity, or that I inform you of, offer knowledge regarding or demonstrate— nor have I assumed, nor at any time hereafter will assume, responsibility for the accuracy, completeness or usefulness of said information, methods, techniques, modalities or products.

Furthermore, you agree to inform Marshall Thompson and Marshall Thompson, LLC, of any disease process, allergies, or symptoms that you are suffering from as well as any medications (prescription or over‐the counter), nutritional supplements, homeopathics, botanicals (herbs), or health food products that you are taking. As well as informing me if you are pregnant, suspect you are pregnant, or you are breast‐feeding. 

You further expressly acknowledge, agree and understand that you have certain responsibilities and duties at all times relevant hereunder, including but not limited to being responsible for your own well-being. If you bring to my attention or if I notice anything of concern, you expressly acknowledge and agree that I may refer you to an appropriate health care provider in my sole discretion and judgment, but I am not obligated to do so. You expressly acknowledge and agree it is your responsibility to follow-up as appropriate on my recommendations (if any), and you do not hold me responsible for any further follow-up or provision of additional services or assistance.

Furthermore, you acknowledge that I have not represented to you in any way that contracting for my services guarantees that you are healthy and free from any health risk, or that you will not suffer injury if you follow my judgment and advice in a way as you may determine. 

Now, therefore, in consideration of the above acknowledgements, you, on behalf of yourself and your heirs, administrators, personal representatives, executors, and assigns hereby RELEASE AND FOREVER DISCHARGE Marshall Thompson, LLC and 

Marshall Thompson from any and all damages or causes of actions, either at law or in equity, which you may have or acquire or which may accrue to you or your heirs, administrators, personal representatives, executors, or assigns as a result of using and/or receiving my services or otherwise performing, not performing, relying, or not relying on any information herein referenced. You acknowledge and agree that you have read all statements contained herein, understand them and have been given the opportunity to ask questions, that those questions have been answered to patient's satisfaction, and that you intend this to be a COMPLETE RELEASE AND DISCHARGE as to me and all protected parties as identified herein from any and all liability whatsoever.
